The so-called SAFE Drugs Act (S.3794) is putting compounding during times of shortages at risk.

If enacted as written, it would gut compounding medications during shortages, restricting pharmacies’ ability to prepare needed therapies when FDA-approved products are in shortage and manufacturers cannot meet patient need.

This is not abstract. This is about whether a patient can get the medication their physician prescribed when the commercial supply chain fails them.

Let’s also be clear: S.3794 applies to state-licensed pharmacies already operating under state law, USP standards, and federal requirements. It does not solve the real problem of fraudulent, counterfeit, or illicit substances being sold outside the regulated pharmacy system.

Congress should go after bad actors. It should not leave patients with fewer options when approved products are unavailable.
